Terms of Use

These terms govern your use of remigrace.com and any order you place with us. By using the site or placing an order you accept them. Please read the sections on liability and stock, which affect your legal rights.

1. Who we are

Remi Grace® is a retailer of imported Spanish and European childrenswear, operating remigrace.com. Contact: hello@remigrace.com.

2. Using this site

You may browse and use the site for your own personal, non-commercial purposes. You agree not to use it for any unlawful purpose, not to attempt to gain unauthorized access to any part of it or its underlying systems, not to interfere with its operation, not to scrape or bulk-download its content or images, and not to place orders using false details or a payment method you are not authorized to use.

3. Accounts

If you create an account you are responsible for keeping your password confidential and for activity that happens under it. Tell us promptly if you believe it has been compromised. We may suspend or close an account that is being used in breach of these terms.

4. Products and descriptions

We sell clothing and accessories for babies and young children, imported from Spain and elsewhere in Europe. We photograph and describe every item as accurately as we can. Colors may render differently between screens, and hand-finished garments carry small natural variations in stitching, shade and trim — this is a characteristic of the work, not a fault.

5. Sizing

European childrenswear is generally cut smaller than the equivalent US size, and sizing differs between brands. We publish measurements where we have them. If you are unsure, email us before ordering.

6. Product safety

Children's products we sell are covered by the applicable US children's product safety requirements, and we hold the supplier certificates, including for sleepwear. Follow the care and age guidance supplied with each garment. Remove any detachable trim before giving a garment to a child young enough to mouth it.

7. Prices and payment

Prices are shown on each product page in US dollars. Applicable sales tax and shipping are calculated and displayed before you confirm payment. We may change prices at any time, but a change will never affect an order already confirmed. Payment is taken at the time of order through Stripe; we accept the card types shown at checkout. If your payment is declined or reversed we may cancel the order.

8. Orders and acceptance

Your order is an offer to buy. A binding contract is formed only when we send you a dispatch confirmation. We may decline or cancel an order, refunding you in full, if the item is out of stock, if it was listed at a manifestly incorrect price, if we cannot verify the payment or delivery details, if we suspect fraud, or if we cannot lawfully ship to your address.

9. Stock and availability

We stock shallowly and reorder frequently, and many pieces are made in small quantities. Listing an item is not a guarantee of availability. If something sells out between your order and dispatch, we will contact you and refund that item in full.

10. Delivery

Delivery is governed by our Shipping policy, which forms part of these terms. Delivery estimates are provided by carriers and are not guaranteed. Risk of loss passes to you on delivery. International customers are responsible for import duties and taxes.

11. Returns and cancellation

Returns are governed by our Returns & Refunds policy, which forms part of these terms. Nothing in these terms limits your statutory rights as a consumer, including any right to reject faulty goods.

12. Intellectual property

The Remi Grace® name, logo and marks, and the text, layout and graphics of this site, belong to us. Product photography and brand names belong to us or to the manufacturers whose goods we stock and are used with permission. Nothing on this site may be copied, reproduced, republished or used for commercial purposes without our written consent.

13. Anything you send us

If you send us a review, photograph or comment, you grant us a non-exclusive, royalty-free license to use it in connection with the shop, and you confirm it is yours to give and does not infringe anyone else's rights. We may remove any submission at our discretion. Please do not send us photographs of other people's children without their parent's permission.

14. Disclaimers

The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free, or that the server is free of harmful components. To the extent permitted by law we exclude all implied warranties, except those that cannot lawfully be excluded.

15. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential losses, or for loss of profit, revenue or opportunity. Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products where liability cannot lawfully be excluded, or for anything else that cannot lawfully be limited.

16. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms or your unlawful use of the site.

17. Privacy

Our handling of personal information is described in our Privacy Policy, our California Privacy Notice and Your Data.

18. Events outside our control

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including carrier failure, customs delay, industrial action, supply interruption, extreme weather, or interruption of utilities or telecommunications.

19. General

If any provision of these terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours if the business is sold, without affecting your rights. These terms are the entire agreement between us regarding your use of the site.

20. Governing law

These terms and any dispute arising from them are governed by the law of the state in which Remi Grace has its principal place of business, and the courts of that state have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence.

21. Changes

We may update these terms. The version in force is the one published on this page at the time you place your order.
